Terms & Conditions

These terms and conditions (the "Terms") form an agreement between HD Melmods ("we", "us" or "our") and you ("you" or "your"), and govern your use of the HD Melmods Sandbox Mod mobile application and any related products or services (the "Service").

1. Acceptance of these terms

You acknowledge that you have read and understood these Terms and agree to be bound by them, together with our Privacy Policy, which is incorporated by reference. If you do not agree, you are not authorised to use or access the Service.

2. Age requirement

You must be at least 13 years old to use the Service. By using the Service you represent that you are at least 13 years of age. If you are under the age of majority where you live, you may use the Service only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.

We do not knowingly permit users under 13 to use the Service. See Section 10 of our Privacy Policy.

3. Subscriptions and payment

Some content and functionality is available only through a paid subscription. Subscriptions are offered on a recurring basis; the available durations, prices and the currency are shown in the app before you confirm a purchase.

• Payment is charged to your Apple ID account when you confirm the purchase.
• A subscription renews automatically unless auto-renewal is turned off at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours before the end of the current period, at the price disclosed to you for that renewal.
• You can manage your subscription and turn off auto-renewal in your Apple ID account settings after purchase.
• An active subscription removes advertising from the app for its duration.

Refunds. Purchases are processed by Apple, and refunds are handled by Apple in accordance with its own policies. We are not able to issue refunds directly. Except where required by law, subscription fees are non-refundable and there is no refund for a partially used period.

If you delete the app without cancelling, your subscription continues and continues to be charged until you cancel it through your Apple ID account settings.

4. Your account

You may use much of the Service without an account. If you create one, you are responsible for maintaining the confidentiality of your sign-in credentials and for all activity that occurs under your account. Notify us promptly at [email protected] if you believe your account has been compromised.

You may request deletion of your account at any time, as described in Section 9 of our Privacy Policy. We may suspend or terminate your access to the Service if you breach these Terms.

5. Acceptable use

You agree not to use the Service:

• for any unlawful purpose, or to solicit others to perform unlawful acts;
• to violate any applicable law or regulation;
• to infringe our intellectual property rights or those of any third party;
• to harass, abuse, insult, defame, intimidate or discriminate against anyone;
• to submit false or misleading information, or to impersonate any person or entity;
• to upload or transmit viruses or any other malicious code;
• to collect or track the personal information of others;
• to spam, phish, spider, crawl or scrape the Service;
• to interfere with or circumvent the security features of the Service; or
• to interfere with, disable or place undue load on our servers or networks.

We reserve the right to terminate your access to the Service for any breach of this section.

6. Content and downloads

The Service is a catalogue and download manager. It does not sell mod files. Mods are created and published by third parties; we provide a convenient way to find, download and install them. Each mod is credited to its author or source where that information is available.

You are responsible for how you use any file you download, and for complying with the terms attached to it by its author and by the game it modifies. Installing mods may affect the stability of the game and is done at your own risk.

Takedown requests. If you are a rights holder and believe that content available through the Service infringes your rights, contact us at [email protected] with the name of the mod, a description of the work you claim is infringed, and a statement of your authority to act. We will review and remove infringing content promptly.

7. Fair use statement

This app may reference material whose use has not been specifically authorised by the copyright owner. Content within the Service is provided for criticism, review, research and informational purposes. Intellectual property not created by or for us has either been used with permission, credited to its author, or is believed to be in the public domain.

We believe this constitutes a "fair use" of any such copyrighted material as provided for in section 107 of the United States Copyright Act. All screenshots and file names were generated and provided by users or were publicly available, and we have no reason to believe that they negatively affect the market value of the copyrighted works.

We do not support any use of this material beyond fair use. If you wish to use copyrighted material from the Service for purposes that go beyond fair use, you must obtain permission from the copyright owner. Nothing here constitutes legal advice.

8. Intellectual property

These Terms do not transfer to you any of our intellectual property or that of any third party. All right, title and interest in the Service — including its software, design, text and logos — remains with us or our licensors. Trademarks, service marks, graphics and logos used in connection with the Service may be the trademarks of third parties, and your use of the Service grants you no licence to reproduce or otherwise use them.

9. Backups

You are solely responsible for maintaining backups of any content you care about. We are not liable for any loss of content residing in the Service. On occasion, and with no obligation to do so, we may be able to restore data that we happened to back up for our own purposes, but we make no guarantee that any particular data will be available.

10. Links to other applications

The Service may link to other applications and websites. Such links do not imply approval, association, sponsorship, endorsement or affiliation unless expressly stated. We do not examine or evaluate, and do not warrant, the offerings or content of any third party, and we assume no responsibility for their actions, products, services or content. Review the terms and privacy policies of any destination you visit; linking away from the Service is at your own risk.

11. Disclaimer of warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any defect will be corrected, or that files available through the Service are free of harmful components.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

12. Limitation of liability

To the fullest extent permitted by applicable law, in no event will we, or our affiliates, officers, directors, employees, agents, suppliers or licensors, be liable for any indirect, incidental, special, punitive or consequential damages — including loss of profits, revenue, data, goodwill or business interruption — however caused and under any theory of liability, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, our aggregate liability relating to the Service will be limited to the greater of one US dollar or the amount you actually paid us in the one month preceding the event giving rise to the liability. These limitations apply even if a remedy fails of its essential purpose.

Some jurisdictions do not allow the limitation of liability for certain damages, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold us and our affiliates, directors, officers, employees and agents harmless from any liabilities, losses, damages or costs, including reasonable legal fees, arising from third-party claims relating to your content, your use of the Service, or any wilful misconduct on your part.

14. Governing law

These Terms are governed by the laws of the Socialist Republic of Vietnam, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be submitted to the competent courts of Vietnam.

Nothing in this section deprives you of the protection of any mandatory consumer-protection law of the country in which you reside.

15. Severability

If any provision of these Terms is held to be illegal, invalid or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect.

16. Changes to these terms

We may modify these Terms at any time, effective upon posting an updated version. When we do, we will revise the "Last updated" date at the top of this page. If the changes are material we will give notice within the app before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
